Newsletter Terms and Conditions
1. These terms and conditions (Conditions of Service) regulate the provision by TicketOne S.p.A., with registered office in Via Fabio Filzi, 29 - 20124 Milan, Italy (TicketOne) of a service consisting in the transmission of informational communications by email (Newsletter Service or Service) concerning the events on sale on the Website “ticketone.it” (Website).
2. These Conditions of Service are placed at the user’s disposal in the relevant section named Conditions of Service and are available through a specific link contained on the website’s pages. They may be amended at any time. Any amendments will be effective as of their publication in the aforesaid section of the Website.
3. The Newsletter Service is free of charge and is activable only under specific user request. Consequently, the processing of personal data of the user who activates the service is done on the basis of the consent provided in accordance with Article 6 Paragraph 1, lett. a) of the GDPR and Article 130 Privacy Code (Legislative Decree No. 196 of June 30, 2003), as indicated in the Privacy Policy in paragraph 3 point 3.9.).
4. The user can activate the Service:
• by ticking the relevant box in the course of the purchase procedure;
• by entering his/her email address and clicking on the relevant button contained in the areas of the Wesbite dedicated to the subscription to the Service,
• within the section “Newsletter and Ticket Alert” of his/her account.
In case of users not yet registered with the Website, the request to subscribe to the Newsletter Service is not the same as registering on the TicketOne.it website.
The user can unsubscribe at any time by using the the opt-out link provided in the footer of the newsletters received at the e-mail address indicated when the Service has been activated, or by accessing the “Newsletter and Ticket alert” Area of his account. or by writing an email to the address: privacy@ticketone.it
Users that are also registered to the website, and therefore have a customer account, can log in to “My TicketOne Area” in order to review, manage and change their newsletter subscriptions.
5. The Service will be active starting from the date of its activation by the user and will last until it is deactivated by the user, according to the procedure above described.
For the period of effectiveness of the Service (and consequently from its activation by the user until its deactivation by the same as detailed above) TicketOne could send a weekly Newsletter containing a selection of the events on sale (or which will be on sale) on the Website, and/or other information concerning the aforesaid events (General Newsletter).
6. In the event that the user has provided his/her post address, in addition to the General Newsletter, TicketOne will also send him/her [at least once a year, and on condition that events are available], in addition to the General Newsletter, also a Newsletter containing a selection of the events on sale on the Website that will take place in the relevant region (Regional Newsletter).
7. In the event that the user has provided further information, TicketOne reserves the right to send to the same, in addition to the General Newsletter, also Newsletters dedicated to one or more specific events and/or artists that are deemed of interest to all users selected in accordance with a presumption of interest not operated through electronic processing methods and individual evaluations nor based on an analysis of the user’s behaviour, but generally made by TicketOne on the basis, for instance, on the user’s gender, age or post address.
8. Personal data collected within the context of the subscription to the Newsletter Service will be processed by TicketOne, acting as data controller, as specified in the Privacy Policy of the website, which you are invited to refer to.
In the event that the user has expressed his or her consent to the processing of personal data for profiling purposes, as indicated at Paragraph 3 point 3.1. of the Website’s Privacy Policy, TicketOne also reserves the right to send Newsletters concerning events in line with the user’s profile and/or relating to artists and/or events in connection with which the user has already made purchases and/or with similar events or artists. Without prejudice and better specifying what is indicated in the Privacy Policy, we inform you that the personal data provided within the context of the Newsletter Service will be processed throughout the whole period of service, as defined at the previous Paragraph 5, and later on, for the period indicated into the Privacy Policy of the Website.
9. In the event that the user has also activated the “Ticket alert” service concerning a specific artist, TicketOne will also send him/her specific Newsletters dedicated to the artist and/or the relevant events, for instance in connection with the opening of sale or other intiatives connected to the same.
In the event that the user has also downloaded the TicketOne app and upon his consent to send and receive notifications, TicketOne may send Newsletters to the user not only by e-mail but also by means of push notifications on the mobile device where the app is installed.
10. TicketOne reserves the right to change, at any time, the frequency of the Newsletter and to suspend the Service on certain days and/or periods of the year and/or for technical reasons, such as for instance in case of holidays/in summer. TicketOne may withdraw from the Service at will, and consequently may interrupt the sending of the Newsletters and/or the provision of the Service on a permanent basis, even without informing the user, and the latter will not be entitled to make any claims and/or hold TicketOne liable in any way, including for any damage suffered as a consequence and/or in connection with said interruption. TicketOne will be held harmless against any and all expenses and damages, either direct or indirect, incurred or suffered by the user in case of failure to receive the Newsletter, as TicketOne will be deemed to have fulfilled its obligations hereunder by merely sending the aforesaid Newsletter.
11. The relationship arising out of the subscription to the Service is regulated by the Italian law. The foregoing is without prejudice to the application to consumers users who are not habitually resident in Italy of the more favourable provisions and the irrevocable provisions, if any, set forth by the law of the country of habitual residence of the same.
12. In the event of consumer users, any dispute relating to the application, performance and construction of these Conditions of Service or the relationship arising from the subscription to the Service will be sumbitted to the decision of the court competent in the user’s place of residence or where the same has elected domicile.
