1. Object

The present Terms and Conditions govern the sale and purchase , by distance or not, of Tickets (as defined below) allowing access to national and international show and/or cultural and sports events made by TicketOne in the name and on behalf of the Organizer (as defined below).

The publication on line of the present Terms and Conditions and the confirmation of the purchase order provided by TicketOne to the Consumer are deemed as “confirmation of the contract on a durable mean” pursuant to article 51, paragraph 7, of the Legislative Decree n. 206/2005 (the “Consumer Code”).

2. Definitions

In these Terms and Conditions the following expressions shall have the meanings set opposite them. Reference to the plural includes the singular and vice versa:

TicketOne: is TicketOne S.p.A., an Italian leading company providing ticketing, marketing, information and e-commerce services for sports, entertainment and culture. In accordance with article 49 of the Consumer Code, TicketOne’s identification data are the following: TicketOne S.p.A., having its registered office in Via Vittor Pisani 19 - 20124 Milan (Italy); tel. +39-02-392261; fax +39-02-3922670; website: www.ticketone.it.

Customer: is the person who purchases the Tickets from the Organizer, through TicketOne Services, by submitting orders on line (e.g. the website and tablet/smartphone applications) or by telephone or through the affiliate sale network of TicketOne.

Consumer: is the Customer who is an individual acting for purposes not related to his/her business or profession, if any.

TicketOne Services: are the services rendered by TicketOne in connection to the sale and purchase agreement of the Tickets entered into by and between the Customer and the Organizer. Such services include Tickets booking, the delivery or any other way to make the Tickets available to the Customer as well as extra services related to the Tickets purchase, if requested by the Customer, with the exception, in any case, of the supply of the service corresponding to the Event, which is exclusively referred to and falls under the sole responsibility of the Organizer as identified in connection to each single Event, in whose name and on whose behalf TicketOne acts.

TicketOne Services Agreement: is the agreement entered into by and between TicketOne and the Customer concerning the supply of TicketOne Services, which is deemed to be governed by the present Terms and Conditions, by the provisions indicated in each single step of the distance selling process, if applicable, and by the contractual conditions printed on the purchased Ticket.

Purchase Agreement: is the agreement entered into by and between the Organizer and the Customer for the purchase of the Ticket, as the result of the supply of TicketOne Services as governed by TicketOne Services Agreement, such agreements are deemed to be governed by the present Terms and Conditions, by the provisions indicated in each single step of the distance selling process, if applicable, and by the contractual conditions printed on the purchased Ticket.

Agreement: is the TicketOne Services Agreement and the Purchase Agreement, considered separately or collectively, as the case may be, and which are governed by the present Terms and Conditions.

Ticket Holder: is the person who legally and in compliance to these Terms and Conditions holds a Ticket purchased by the Customer.

Event:is the show, performance and any other event to which the Ticket allows access.

Festival: means the event, the show or the representation to which the Ticket allows access to the Ticket Holder and where the performance of a plurality of artists is planned in the context of the same Event.

Organizer: is the person who organizes the Event for which the related Ticket has been issued as well as the person in whose name and on whose behalf TicketOne acts and with which the Purchase Agreement is entered into. Pursuant to article 49 of the Consumer Code, the identification data of the relevant Organizer are indicated on TicketOne website in the specific section called “info evento”, containing the description of the relevant Event.

Ticket: is the document even in digital format entitling the Ticket Holder to have access to the Venue.

Venue: is the set of buildings and grounds where a specific Event takes place.

3. Tickets and Events

3.1 Any Ticket Holder must be in possession of a valid Ticket to access to the Venue. The rules applicable to the Customer provided in connection to each single Event or which are in any case applicable to the Customer or to the Event apply to the Ticket Holders.

3.2 The Ticket must be purchased through the TicketOne sale network or from an entity authorized by TicketOne to sell the Tickets. In the event that the customer purchased the Ticket from entities other than those indicated above or if the Ticket is lost, stolen, duplicated or obtained by any other means that do not comply with these Terms and Conditions, the Ticket Holder could be not allowed by the Organizer to access to the Venue or could be forced to leave it.

3.3 The Ticket may not be sold or subject to intermediation by the Customer.

3.4 TicketOne can cancel at any time, at the request of the Organizer or the authorities responsible for public order and security, an already issued Ticket or a purchase order already made for technical and/or organizational reasons (other than those set forth in the following point 7) or whenever the effective payment of the Ticket does not take place.

In such a case the Customer is entitled to a full refund of the Ticket's price and the additional costs paid to TicketOne (including the shipment costs should the shipment not have been effected yet) under the terms and conditions established by the Organizer, unless the cancellation depends on the lack of payment of the Ticket by the Customer.

3.5 TicketOne is neither the exclusive distribution network nor the entity responsible of the ticket sale decisions in respect to the Events, and therefore it is not responsible for the seats allocation in respect of Tickets sold by the Organizer and no warranty is given that the Tickets sold at any given time are the best available at the moment, or that better seats may not be offered for sale by the Organizer at a later stage.

3.6 The price of the Ticket is the one communicated by the Organizer and known to TicketOne at the time the Customer completes the transaction of purchase of the Ticket. If, after the purchase by the Customer, the Organizer applies a lower price in respect of Tickets of the same type or in relation to Events to be held on a given date, the Customer will not be entitled to a refund of the difference.

4. Payment methods

For security reasons, TicketOne reserves the right to apply limitations and exclusions to the payment methods used by the Customer to buy Tickets.

Payments with American Express and Diners Club credit cards are handled via the parent company CTS EVENTIM AG & Co. KGaA, Contrescarpe 75 A, D-28195 Bremen, Germany.

Payments with Visa and Mastercard credit cards are handled by the group company CTS EVENTIM Nederland B.V., Postbus 69507, 1060 CN Amsterdam, Netherlands.

5. Ticket price and service fee

The Tickets price is printed on the Ticket, including presale charges (if any) charged by the Organizer. TicketOne applies a service fee as remuneration for TicketOne Services on each sale transaction, depending upon the agreements with the Organizers and whatever discretional. Such service fees are made explicit in the most suitable way according to the different sales channels used by TicketOne.

The Tickets price, as well as the service fees, the shipment costs and any other different price indicated on TicketOne website, include the applicable VAT.

6. Right of withdrawal

The Consumer acknowledges that the right of withdrawal provided for by article 52 of the Consumer Code does not apply, insofar the Contract concerns the supply of products and services for one’s spare time which the supplier undertakes to provide at a specific date or for a specific performance period.

The right of withdrawal applies however to the sale and purchase of goods other than the Tickets, except if such goods are included in the categories for which the right of withdrawal does not apply according to article 59 of the Consumer Code. In such a case, the right of withdrawal can be exercised within 14 days from the date at which the Consumer has obtained the physical possession of the good purchased, by sending an explicit declaration of his/her decision to withdraw from the agreement through the website: http://www.ticketone.it/recesso.

7. Cancelled or Postponed Event

7.1 As a mere supplier of TicketOne Services and acting in the name and on behalf of the Organizer in connection to the sale of the Tickets, TicketOne shall not be responsible in any case for any postponement or cancellation of the Event by the Organizer. In case of postponement or cancellation of the Event by the Organizer, TicketOne shall notify to the Customer, in the name and on behalf of the Organizer itself, the measures which the latter will have adopted as to the refund or the change of the Tickets related to the Event which is postponed or cancelled.

7.2 Without prejudice to the provisions of point 7.1. above, in no case the Customer is entitled to request to TicketOne the refund of the service fees, of the insurance policy premium, if any, of the shipment costs (if such delivery mode of the Tickets has been chosen by the Customer) and of the cost of the gift wrapping chosen by the Customer, if any, such amounts representing the remuneration of the supply of TicketOne Services already provided by TicketOne and being independent of the following supply of the Event by the Organizer.

It being understood that it will be up to the Organizer to decide whether to refund the presale right or not, the Customer acknowledges that, also for the purposes of his buying decision awareness, the presale rights possibly withdrawn by the Organizer shall not exceed 13% of the total Ticket price.

When the Organizer notifies the cancellation of an Event and the refund of the relevant Ticket, TicketOne, if so delegated by the Organizer, will handle the refund operations, in accordance with the timing and instructions decided by the Organizer and to the extent that TicketOne has received the relevant funds by the Organizer. The Tickets concerning these Events cannot be changed with Tickets concerning other Events.

7.3 If the Event consists of a Festival, the listing on TicketOne website of the names of the artists taking part in it shall be deemed to have indicative purposes only and therefore, if one or more artists who are expected to take part in the Event does not participate or is substituted, the missed participation or the substitution shall never be deemed as cancellation of the Event, unless the whole Event is cancelled by the Organizer.

7.4 TicketOne will not replace a Ticket in the event the Ticket is lost, damaged, destroyed, stolen or becomes even partially not readable because presented by the Ticket Holder in any way damaged.

8. Despatch and delivery

8.1 In case of sale on line the Customer is entitled to choose among the following delivery options: (i) delivery to the Customer’s domicile (subject to the refund of shipping costs as they that will be made known in the purchase process), (ii) collection at the Venue and the date of the Event and (iii) when made available by TicketOne, self-printing of the Tickets at his / her domicile, except in case the Organizer requires a mandatory advanced delivery to the Customer.

8.2 In case of collection at the Venue or at any other place indicated by the Organizer, the collection is possible starting at least one (1) hour before the Event begins.

8.3 If the Customer requires the dispatch of the ticket to his / her domicile, the relevant delivery will be made by courier within few days from the purchase date.

8.4 If the Customer requests the printing at his / her domicile or the ticket in digital format, the Customer shall comply with all the requirements indicated on the website www.ticketone.it.

9. Limitation of liability and TicketOne rights

Except in the case of gross negligence or fraud, TicketOne shall not be liable for any cost and damage, direct and indirect, suffered by the Customer in connection with the Ticket sale. TicketOne also reserves the right, except with reference to an already concluded transaction with a Consumer, to interrupt, change, suspend or terminate every services concerning Tickets sale if this is necessary or appropriate for technical and/or organisational reasons.

10. Restrictions

Tickets may not be used for political, commercial, advertising or other promotional purposes (including but not limited to the use as competition or lottery prizes), unless a prior written authorization is given by the Organizer and/or by TicketOne, if so authorized by the Organizer.

In case of use of the Tickets by the Customer in violation of the provision above, the Customer shall be liable for any damage which may arise out of it and may be called to Court.

11. Miscellanea

11.1 If any provision of these Terms and Conditions is held unenforceable, these Terms and Conditions shall continue to be fully enforceable as to their other provisions.

11.2 The Agreement shall be governed by Italian law.

The application of the United Nations Convention on Contracts for the International Sale of Goods signed in Vienna on 11th April, 1980 is expressly excluded.

The Court of the Consumer’s place of residence or domicile shall have exclusive competence for any dispute arising from the Agreement and / or these Terms and Conditions. In any other case, the Court of Milan (Italy) shall be deemed exclusively competent.

11.3 The present Terms and Conditions, the different provisions indicated in each single step of the distance selling process, if applicable, and the contractual conditions on the Ticket contain the entire agreement between the Customer and TicketOne.

In case of conflict between this English version of the Terms and Conditions and the Italian version of the same as published by TicketOne, as well as in case of conflict between any other content of the Agreement in the English version in respect to the corresponding Italian version, the Italian version shall prevail.
